Spring Break Safety Tips for College Students: Awareness is Half the Battle

Known in the college world as Fat Tuesday, February 21st is really just an excuse for celebration. There isn’t any harm in finding things to celebrate in life; really life should be about the small things. This time of year also brings school vacations for students. For college students this is one of the best times of year; SPRING BREAK!

Depending upon the school attended, and the allotted time off for students; typically students head for warmer climates. Florida and California are some of the popular states within the United States, but many times students head overseas for all inclusive stays with friends. Mexico is a high traffic area during late February and March. Busy with both college students, and criminals waiting to pray on these college students. American teenagers need to remember they are not in their native country, and should be extra careful and conscious of their surroundings.

Awareness is half the battle, but sometimes college students get caught up in the heat of the moment. Many times these students are newly able to drink, and alcohol is often a factor, present at the scene of bad decisions. Most times criminals target students on a spring break vacation because of opportunity. Such as, they are seen with a pricey item, seen with an abundance of cash, or maybe just being careless when it comes to their surroundings. The main point is, these are crimes of opportunity, if the opportunity is not given they won’t take place. Obviously these situations cannot always be avoided, but understanding that you need to be EXTRA careful is vital.

Some things can only be learned by experience, and going on your first vacation without any parents is most certainly a learning experience (especially if it’s to another country). Especially during this spring break time, criminals are just waiting for the right opportunity to prey on unsuspecting travelers. Research has shown that many times criminals will even hang out around spring break filled hotels, be sure you don’t count the hotel staff completely out. Use your intuition in deciding if you can trust your hotel staff members, usually the hotel staff is very helpful and informative about the local area.

It’s important to keep a low profile, especially when it comes to money and spending. First, before you leave for an international vacation, it might be a good idea to alert your bank. When actually on the trip, the last thing you want to do is let anyone know that you have money on your person, or valuables in your hotel room. Especially in this economy, criminals are increasingly desperate. Be sure the windows in your hotel room are locked at all times, and you’re being choosey in giving people the number to your room or hotel name.

If you do need to visit the ATM, one inside the hotel is your best bet. If this is not possible find a well lit area that you feel safe; asking a trusted member of the hotel staff is a good strategy. If you plan to do some shopping while on your vacation, especially if this will be from street vendors using cash; have your money separated. The last thing you want to do is put a bulls-eye on your forehead by revealing all the cash you have for vacation in your wallet. This is definitely asking for trouble.

Although calls from your cell phone might be expensive since they are likely international; it’s still smart to have your phone with you! Just in case something were to happen, you’re going to want to be able to contact that girl that’s separated from the group, your parents, or even emergency services in that emergency situation. It’s smart to stay in groups and not veer off alone, but if someone does get separated you can stay in communication with them, or even quickly determine that something is not right. Don’t leave yourself without any means to communicate with others. Even during the bright sun of the day, when in another country, it’s important to be on high alert all the time.

Preparing and protecting yourself is really all you can do. To all college students: have an amazing and safe spring break vacation.

Boston Red Sox 2012 Spring Training: Ch Ch Ch Changes!

It’s almost Boston Red Sox season again, and just as expected, lots of changes have taken place during the off season. With less than a week remaining until the start of Spring Training the heat is on to cheer up Boston sports fans since that recent let down by the Patriots in the Super Bowl.

Boston fans are hoping that, unlike Terry Francona during the 2011 season, Bobby Valentine will lead the Sox to the post season. Let’s face it, a sports organization isn’t so different from owning a business; passion, problem solving, and change are all needed to be successful. Game time means it’s time to get out there and give it your ‘A’ game, no matter what.

Property Owners: Make Note of Change to Massachusetts Snow and Ice Removal Legislation

Hopefully this isn’t the first you’re hearing of the change in law here in Massachusetts, since it’s been in effect for over a year now! In July 2010 a Supreme Judicial Court decision changed the MA legislation regarding snow removal for property owners. Property owners are now responsible for any injuries occurring due to risky conditions in the snow or ice, on or around their property.

The prior law was known as the Massachusetts Rule which stated that liability was dependent upon the reason for the accumulation of snow in which the injury occurred. If the accident was caused by a natural accumulation of snow then the property owner was not thought to be responsible in the eyes of the law. Well times have changed, and the injured person’s burden of proof has significantly decreased; now Mother Nature’s chaos must be cleaned up in a timely manner (within 12 hours) or the property owner can be held responsible for injury that occurs.

This includes removal of accumulated snow or ice from drivable/walk able areas – including the sidewalks surrounding the premises. The days of avoiding liability exposure by taking no action are long gone. Taking no action to remove snow from your property is no longer a loop hole in MA law; landlords can, and will be held responsible. This change in law affects both residential, as well as commercial properties. When it comes to litigation, punishments/awards will be examined on a case by case basis and dealt with accordingly.

Landlords are expected to act reasonably to avoid injuries to others, as well as to decrease hazards in general on and around their property. The idea is that property owners will take measures to remove hazardous situations as they are happening or as soon as possible. Unfortunately a side effect of this change in legislation will be an increased number of personal injury claims. Public safety is the main concern with this changing law.

With this increased exposure for property owners, comes a need to be sure you have the proper liability coverages whether you’re a landlord or a home owner. Since your insurance coverage will defend you against claims of personal injury, being properly insured is more essential then ever. Great MA Winter Activities: Enjoy!

Since the groundhog Punxsutawney Phil informed us that we’ll be having another six weeks of winter, we might as well take advantage of the fun to be had here in Massachusetts. After all, this really is a wonderful (and strangely snow-free) time of year. Although many people would rather Spring come a little early, not to worry; it’ll be here before you know it.

New England Patriots Fans: How to Host a Super Bowl Party at Your Massachusetts Home

Let’s kick off February right with a killer Super Bowl celebration! Since our home team will be taking on the New York Giants in Indianapolis, most New Englanders will likely be watching Super Bowl XLVI from home with lots of food, drink and celebration.

With only a few days before the big game, it’s time to get planning! Usually it’s the friend with the biggest TV and most couch space that wins the honor of hosting the Super Bowl party. If the carousing will be at your residence you’ll want to be sure that you have everything thought out ahead of time; including planning for the unknown.

Having the proper insurance coverage to protect you and your stuff is always a good idea, but risky situations make this especially true. The hope is that everyone will manage their behavior and act responsibly, yet this isn’t always how it happens. As the property owner you have an increased obligation to not only act responsibly yourself, but also, to make sure that your guests do the same. As the party host, you could be held responsible for your actions, and ultimately, the actions of others that attend your Super Bowl party.

From an insurance stand point, proper homeowners liability insurance coverage, as well as an umbrella policy, would be the coverage that will protect you. And remember, anything illegal, like serving alcohol to a minor, could void any coverage you have under your homeowners insurance policy.

Another potentially damaging situation might be if a guest claims that you intentionally got them intoxicated before letting them operate a motor vehicle. Designating drivers, calling taxis, or just limiting alcohol consumption are all ways to protect yourself.

It’s never a good idea to invite any New York Giants fans to your home since they are rooting for the wrong team! But this is especially true during a high intensity game like the Super Bowl. Property owners can be held responsible for physical altercations that occur on their property, especially if the cause is foreseeable. This might sound a little silly, but as the homeowner you have a responsibility to protect your party guests, as well as make sure they are not endangering themselves or others after leaving your home.

And don’t forget to make sure you have adequate personal property coverage on your policy too. We’ve heard many stories of expensive, HD flat screen TVs being damaged during poor Super Bowl plays!

Hand-Held Devices are Banned Nationally for Commercial Drivers: Massachusetts Commercial Fleets take Notice

This just in from the Massachusetts Association of Independent Agents (MAIA) January Newsletter; after some confusion regarding the National cell phone ban for commercial drivers, the MAIA published some frequently asked questions to help clarify and explain the regulations further. Within Massachusetts, State Police are strictly enforcing these regulations in the interest of keeping the roads safe. Massachusetts company owners and managers should spread the word of this cell phone ban to their fleet of drivers; awareness is half the battle!

  1. Q: What is the effective date of the Mobile Telephone rule?
    A: The effective date of the rule is January 3, 2012.
  2. Q: Are wired or wireless earpieces allowed?
    A: Yes. Hands-free use of a mobile telephone is allowed using either a wired or wireless earpiece, or the speakerphone function of the mobile telephone. Wireless connection of the mobile telephone to the vehicle for hands-free operation of the telephone, which would allow the use of single- button controls on the steering wheel or dashboard, would also be allowed.
  3. Q: Is Push-to-Talk allowed?
    A: No. A driver’s use of the Push-to-Talk function on a mobile telephone violates the prohibition against holding the phone. This includes the continuous holding of a button that is necessary to use a Push-to-Talk feature through a mobile telephone, even when the driver is using a connected microphone or wireless earphone.
  4. Q: Are holders of a commercial driver’s license (CDL) subject to the regulation only when driving a CMV, as defined in 49 CFR 383.5, or any vehicle?
    A: CDL holders are subject to the Federal rule only when driving a CMV.
  5. Q: What drivers are covered by the Federal rule: intrastate or interstate? CDL holders? All CMVs?
    A: The rule covers both drivers of CMVs in interstate commerce and intrastate drivers who operate CMVs transporting a quantity of hazardous materials requiring placarding under 49 CFR Part 172 or any quantity of a material listed as a select agent or toxin in 42 CFR part 73. If a CMV driver is employed by a State or a political subdivision of a State (e.g. county, city, township, etc.), FMCSA safety regulations do not apply, even if the driver is engaged in interstate transportation. But if a CMV driver employed by a State or a political subdivision of a State is operating a vehicle that requires a CDL, the applicable State traffic laws would govern (e.g., Maryland’s prohibition on the use of hand-held phones). The States have three years to implement by State law the disqualification provision.
  6. Q: What is required of the employer in terms of company policy or training?
    A: The rule does not require motor carriers to establish written policies in terms of company policy or training programs for their drivers. However, employers are prohibited from allowing or requiring their drivers to use hand-held mobile phones. A motor carrier may establish policies or practices that make it clear that the employer does not require or allow hand-held mobile telephone use while driving a CMV in interstate commerce. The carrier is responsible for its drivers’ conduct.
  7. Q: Is dialing a phone number allowed under this rule?
    A: No. Dialing a mobile telephone while operating a CMV in interstate commerce is prohibited by the rule. A driver can initiate, answer, or terminate a call by touching a single button on a mobile telephone, earpiece, steering wheel, or instrument panel – comparable to using vehicle controls or instrument panel functions, such as the radio or climate control system.
  8. Q: Can a driver reach for a mobile telephone even if he/she intends to use the hands-free function?
    A: No. In order to comply with this rule, a driver must have his or her mobile telephone located where the driver is able to initiate, answer, or terminate a call by touching a single button while the driver is in the seated driving position and properly restrained by a seat belt. If the mobile telephone is not close to the driver and operable while the driver is restrained by properly installed and adjusted seat belts, then the driver is considered to be reaching for the mobile phone, which is prohibited by the rule.
  9. Q: Are tow trucks exempt?
    A: No. The interstate operation of tow trucks that meet the definition of a CMV are not exempt. Tow trucks, however, are exempt when responding to police emergencies in accordance with 49 CFR 390.23 (a)(3).

Penalties:
The new rule prohibits commercial drivers from reaching for, holding or dialing a cell phone while operating a CMV. Drivers who violate these restrictions face federal civil penalties of up to $2,750 for each offense and disqualification of their commercial driver’s license (CDL) for multiple offenses. Additionally, states would suspend a driver’s CDL after two or more violations of any state law on hand-held cell phone use. Motor carriers that allow their drivers to use hand-held cell phones while driving would face a maximum penalty of up to $11,000. Approximately four million interstate commercial drivers would be affected by this proposal.

A driver is disqualified from operating a commercial motor vehicle (CMV) for 60 days with the second offense in three years, and 120 days for each subsequent offense within 3 years. This penalty only applies if the violation occurred while driving a CMV.

Digital DSLR Camera Workshop at Franklin Art Center

The holidays have passed, and things are beginning to settle down. Finally you have some time to squeeze in an afternoon of “me” time and learn how to use that digital DSLR camera that Santa got you. Let’s face it… the manual doesn’t really help, it just confuses you more!

On Saturday, January 7th, 2012 from 12:30-4PM, Franklin Art Center will be holding a workshop called “So I got a new DSLR camera? How do I get started?” This will be a mixture of lecture, demonstration, and hands-on activity. The instructor is Nicole Connolly, a professional photographer who graduated from the Center for Digital Imaging Arts at Boston University. For the past 4 years, she has also been working as a professional photographer shooting fine arts, editorials and advertisements.

Franklin, Massachusetts finally has a Dog Park to Call their Own

Finally a place for dogs to run wild and play in Franklin! Did you know that Franklin, Massachusetts now has a park especially for dogs? Franklin residents no longer have to leave town in search of somewhere to take their pooch to play.

The new park is located at Dacey Community Field on Lincoln Street in Franklin, Massachusetts. The field has an amazing playground, as well as two baseball fields; there are plenty of activities for the whole family to enjoy. If you haven’t stopped by to check out the great facilities, be sure to make some time!

Thanks to Haley Goulet, an eighth grade student at Benjamin Franklin Classical Charter Public School this dog park project really took off the ground. Haley started this as a community service project for school, and made the Franklin Dog Park a reality for the community. Many community members and businesses have made generous contributions to fund Haley’s great idea (minimal public resources were used).
